Survival Actions in California After a Death in Fresno, CA The Estate's Own Surviving Claim

The claim the person who died owned at the moment of death does not vanish with them. It becomes an asset of the estate, with its own owner, its own damages rules, and its own filing mechanics. This page describes that second claim in general terms and is not legal advice.

Two claims, two owners

A survival action is the decedent's own cause of action, continued after death rather than created by it. Code of Civil Procedure section 377.30 provides that a cause of action that survives passes to the decedent's personal representative or, where none exists, to the decedent's successor in interest, and that it may be enforced by that person. Compare that with the survivors' claim: different plaintiff, different injury, different measure. The same event can generate both, and the paperwork for each is filed by a different party even when everyone involved is in the same family.

Proceeding without a probate estate

Section 377.32 lets a successor in interest bring or continue the action by filing a declaration or affidavit instead of obtaining letters of administration. The statute prescribes what that document contains, including the decedent's name and date and place of death, a statement that no proceeding is now pending in California for administration of the estate, the declarant's basis for succeeding to the claim, and a statement that no other person has a superior right. A certified copy of the death certificate attaches to it. This route saves a family that has no other reason to open probate from opening one, but the declaration is a sworn document and the superior-right statement is the part people get wrong.

What the estate's claim can and cannot collect

Section 377.34 sets the measure. Recovery is limited to what the person lost or spent while still alive, plus any penalty or punitive award that person could have obtained had they survived, and the section keeps pain, suffering, and disfigurement out of that calculation. That single exclusion is the reason two claims arising from one death can be valued so differently. Medical charges, ambulance and hospital billing, lost earnings between injury and death, and property damage belong to the estate's side of the ledger.

The temporary exception, and its expiry

The section carries a limited exception. For an action that was granted a preference under section 36 before January 1, 2022, or that was filed on or after January 1, 2022 and before January 1, 2026, damages for the decedent's pain, suffering, or disfigurement are recoverable. The Legislature attached a reporting mechanism to that window: a plaintiff who recovers such damages must report the judgment to the Judicial Council within sixty days, with the case details the statute lists. Whether that window applies to a given case depends on its filing date, which is one more reason the calendar governs this area more than the facts do.

Where elder and dependent adult claims diverge

Welfare and Institutions Code section 15657 changes the arithmetic for a narrow class of cases. Where a defendant is found liable for physical abuse or neglect of an elder or dependent adult with recklessness, oppression, fraud, or malice, and the standard of proof in the statute is met, the court awards reasonable attorney's fees and costs, and the statute states that the limitations of section 377.34 on damages recoverable after death do not apply. It then caps damages for the decedent's predeath pain and suffering by reference to the limit in Civil Code section 3333.2. That combination is why care-facility deaths are analyzed on a separate track.

Practical consequences worth knowing early

Records that only the estate's representative can request tend to be the records that decide the case. Hospital and billing files, employment and payroll data, phone and vehicle data, and insurance correspondence all move faster once someone holds clear authority. Settling one claim without addressing the other is a recurring problem: a release signed by survivors, or by a successor in interest, can be read more broadly than the person signing intended. Sorting out which claim is which before any money changes hands avoids a fight over what was actually resolved.

Heat rules here are numeric, and a Fresno summer triggers them

California's outdoor heat standard requires potable water of at least one quart per employee per hour, shade when temperatures exceed 80 degrees, cool-down rests of no less than five minutes, and, in agriculture at 95 degrees and above, a minimum ten-minute net cool-down period every two hours.

Why it matters: Fresno's average July high temperature is 97.7 degrees, so the high-heat provisions are routinely in scope. Because the rules are quantified, payroll, break, and temperature records either show compliance or show its absence.

Fresno's public claim deadlines run on months, not years

The County of Fresno requires claims for death to be filed with the Clerk of the Board of Supervisors at 2281 Tulare Street, Room 301, and states they are not accepted by email or fax; the City of Fresno requires its Claim for Damages form in duplicate at 2600 Fresno Street, Room 1030.

Why it matters: Where a public agency may be responsible, an administrative claim generally comes before any lawsuit and runs on a six-month period rather than years. Two agencies in the same city use different offices and different filing rules.

California uses two different claim paths after a death

California separates a wrongful death action for eligible survivors under Code of Civil Procedure section 377.60 from a survival action that passes the decedent's own claim to a personal representative or, if none, a successor in interest under section 377.30. Section 377.34 generally excludes the decedent's pain, suffering, and disfigurement from survival damages, subject to statutory exceptions.

Why it matters: The people who lost a family member may have their own wrongful death claim, while a different person may need authority to bring the survival action. Keeping those paths separate changes who is included, what documents are needed, and which losses are being evaluated.
