Fatal Vehicle Collision Claims in Fresno County in Fresno, CA Roads, Records and Response Times

A fatal collision in Fresno County can happen on a freeway built in the 1960s, on a two-lane county road, or at a rural intersection an hour from a trauma center. This page describes how those settings change the record and the claim. It is general information, not advice about a specific crash.

What the county's own death investigation shows

The Fresno County Sheriff-Coroner publishes annual case statistics. For 2024 the office recorded 9,185 total deaths in the county, of which 4,350 were reported to the coroner and 1,138 became coroner case investigations with a report produced. Within those investigations, 589 were classified as accidents, and motor vehicle accidents accounted for 193 of them. Bodies transported to the coroner's morgue numbered 1,400. Those figures set the scale of the county's traffic deaths and also explain something procedural: in a case like this a public medico-legal file exists from the beginning, and its contents are usually more durable than anything at the scene.

Roads that were not designed for current traffic

Some of the county's fatality risk is structural. Caltrans describes the South Fresno stretch of State Route 99 as an alignment constructed in 1965 with pavement that is old and highly deteriorated, and notes that only two lanes, one in each direction, cross the existing structures at several interchanges, some of which are half or split configurations. On State Route 41 further west, the department has proposed expanding a 7.1-mile segment in Fresno and Kings counties to four lanes with a 46-foot-wide median, citing congestion, high collision rates, and a lack of passing opportunities on that segment. Design and maintenance history is discoverable, and it is the kind of record that only exists in an agency's files.

Distance to definitive care

Community Regional Medical Center in downtown Fresno describes itself as the only Level I Trauma Center between Los Angeles and Sacramento. For a family, that fact usually surfaces as a timeline: where the injury happened, how long transport took, and which facility made which decision. Those intervals are documented in dispatch logs, air and ground ambulance records, and emergency department charting, and they are worth requesting early because retention schedules for audio and telemetry are shorter than for written charts.

When the defendant might be a public entity

If the condition of a road, a shoulder, a signal, or a crossing is part of the story, the analysis shifts to Government Code section 835, which exposes an agency to liability where its property was in a dangerous condition, provided the claimant proves each element the section lists: causation, a reasonably foreseeable risk of that type of harm, and either creation of the hazard by an employee acting negligently or notice early enough to have guarded against it. The section also demands a much earlier administrative step, described on the deadlines page, that runs on months rather than years.

The two-year rule, and what it does not cover

Where someone else's wrongful conduct or carelessness caused the death, the ordinary window is two years, set by Code of Civil Procedure section 335.1. That is the outer boundary for a private defendant. It is not the operative deadline where a public agency, a government vehicle, or a public road condition is involved, and it is not the deadline for a claim against a health care provider. Assuming the two-year figure applies to every possible defendant in a crash is one of the more expensive assumptions available.

Evidence that disappears on its own schedule

Different parts of a collision record decay at different speeds. Private camera footage overwrites in days. A vehicle held at a tow yard can be released for salvage or auction while a family is still arranging a service. Skid and gouge marks weather. Commercial dispatch data, electronic logging records, and maintenance files exist but are held by the company that generated them. Written requests to preserve, sent early and kept as copies, are what convert those items from likely to available. Photographs of the roadway, the sightlines, and any temporary conditions such as signage, harvest traffic, or dust are cheap to take and impossible to recreate later.

Fresno's public claim deadlines run on months, not years

The County of Fresno requires claims for death to be filed with the Clerk of the Board of Supervisors at 2281 Tulare Street, Room 301, and states they are not accepted by email or fax; the City of Fresno requires its Claim for Damages form in duplicate at 2600 Fresno Street, Room 1030.

Why it matters: Where a public agency may be responsible, an administrative claim generally comes before any lawsuit and runs on a six-month period rather than years. Two agencies in the same city use different offices and different filing rules.

California uses two different claim paths after a death

California separates a wrongful death action for eligible survivors under Code of Civil Procedure section 377.60 from a survival action that passes the decedent's own claim to a personal representative or, if none, a successor in interest under section 377.30. Section 377.34 generally excludes the decedent's pain, suffering, and disfigurement from survival damages, subject to statutory exceptions.

Why it matters: The people who lost a family member may have their own wrongful death claim, while a different person may need authority to bring the survival action. Keeping those paths separate changes who is included, what documents are needed, and which losses are being evaluated.

Fresno's Unlimited Civil cases have a named filing location

Fresno County Superior Court states that Unlimited Civil cases are heard at the B. F. Sisk Courthouse, 1130 O Street, Fresno, CA 93721.

Why it matters: A wrongful death case can require an Unlimited Civil filing, but venue depends on the case facts. When Fresno Superior Court is the correct venue, the filing goes to the civil division at the B. F. Sisk Courthouse on O Street, and the papers have to match that court's own procedures.
