Fatal Truck and Farm Equipment Crash Claims in Fresno, CA Carriers, Implements and Hauling Rules

Farm equipment on a public road, a produce trailer running to a packing house, and an interstate carrier operate under different rules, and after a fatal crash those differences decide which records exist. This page explains the framework in general terms rather than as legal advice.

Slow vehicles on fast roads

California requires that a vehicle or combination designed to be and operated at 25 miles per hour or less display a slow-moving vehicle emblem on the rearmost vehicle, mounted base down between three and five feet above the ground. The Vehicle Code also describes the emblem's geometry: a cut-off triangle whose height must reach 14 inches or more, bordered in red reflective material at least an inch and three-quarters across, with fluorescent orange in the middle. Narrow exceptions exist for certain utility and highway maintenance vehicles working at a jobsite. Whether the emblem was present, clean, and correctly mounted is a factual question with a written standard behind it, and it is one of the first things a family should try to document.

Farm vehicles occupy their own category

Implements of husbandry are treated differently from ordinary commercial vehicles. Caltrans publishes the exemptions: implements of husbandry only incidentally operated or moved over a highway are exempt from registration, and a list of specific farm vehicles is exempt if they display an identification plate. That list includes farmer-owned water tank vehicles used to service the owner's own implements, cotton module movers, trailers equipped with plenum chambers for drying agricultural commodities, certain trap wagons with fuel tanks capped at 3,000 gallons total capacity, and forklifts operated by a farmer not for compensation, with a hay-squeeze treated as a forklift. Exemption from a registration requirement is not exemption from a duty of care, but it does change which agency holds which record.

Hours-of-service gaps in agricultural hauling

Federal driving-hour limits contain an agricultural exception. The Federal Motor Carrier Safety Administration explains that where a trip involves no non-agricultural cargo and its sole purpose is to pick up or deliver agricultural commodities as defined in the rules, driving and on-duty time are not limited and the other requirements of the hours-of-service part do not apply. The exception covers transportation during the initial 150 air miles from the source of the commodity regardless of how far the final destination is, and once a driver operates beyond that radius the ordinary limits apply and those hours must be recorded. In a fatigue case, that boundary determines whether a log even exists for the hours in question.

Truck volume is a local variable, not a background fact

A City of Fresno freight study documents how mixed this traffic is. It notes that State Route 99 is designated part of the National Highway Freight Network and appears among the top 25 key corridors by commodity tonnage in federal freight data, that the city's designated truck routes adopted in 2005 restrict where commercial vehicles over 12,000 pounds may travel, and that on one measured section of State Route 41 an estimated 4,700 average annual daily truck trips made up roughly 4 percent of about 117,500 average annual daily vehicles. A separate observation point north of State Route 180 counted 147,834 daily vehicle trips, with a license plate analysis concluding 13 percent of screened plates were trucks.

Machine safety rules that apply off the highway too

California's construction and general industry safety orders for agricultural operations set expectations for the equipment itself. The rules require that guards and shields be kept in place during operation, prohibit riders on equipment not designed to carry them, and require that power be shut down and the machine secured before servicing, adjusting, or unclogging, with everyone clear before it is restarted. A companion order requires seat belts on agricultural equipment where rollover protective structures are installed, referencing an SAE standard and an anchorage strength requirement. After a fatality, the condition of a guard, a shield, a belt, or a lockout point is physical evidence that a repair can erase within a week.

Sorting out who the defendants are

A single load can involve a grower, a labor contractor, a hauling company, a broker, an equipment dealer, a repair shop, and a manufacturer. Registration, insurance filings, bills of lading, dispatch records, maintenance invoices, and the employment relationship all point at different entities. Where the driver was an employee, the compensation system and any third-party claim run on separate tracks, which is covered on the workplace pages. The useful early step is documentary: photograph plates, placards, decals, trailer numbers, and any visible damage before the equipment is moved or repaired.

California uses two different claim paths after a death

California separates a wrongful death action for eligible survivors under Code of Civil Procedure section 377.60 from a survival action that passes the decedent's own claim to a personal representative or, if none, a successor in interest under section 377.30. Section 377.34 generally excludes the decedent's pain, suffering, and disfigurement from survival damages, subject to statutory exceptions.

Why it matters: The people who lost a family member may have their own wrongful death claim, while a different person may need authority to bring the survival action. Keeping those paths separate changes who is included, what documents are needed, and which losses are being evaluated.

Fresno's Unlimited Civil cases have a named filing location

Fresno County Superior Court states that Unlimited Civil cases are heard at the B. F. Sisk Courthouse, 1130 O Street, Fresno, CA 93721.

Why it matters: A wrongful death case can require an Unlimited Civil filing, but venue depends on the case facts. When Fresno Superior Court is the correct venue, the filing goes to the civil division at the B. F. Sisk Courthouse on O Street, and the papers have to match that court's own procedures.

Agriculture and processing shape Fresno County work records

A Fresno County economic study found that agricultural production and processing directly supported 63,103 jobs in 2023.

Why it matters: A local work death may involve a farm, packing operation, processor, labor contractor, transportation provider, equipment maker, or property owner. Preserving the employer, worksite, equipment, and coworker records early helps determine which relationships need to be examined.
