After a death, the first problem is often not whether something went wrong. It is that the people closest to the person who died are suddenly dealing with records, insurers, employers, and questions that do not have simple answers. This Fresno page explains the work behind a wrongful death claim: protecting evidence, identifying who may bring which claim in California, and putting the family’s loss into a form the legal system can recognize. It is written for a hard week, not for a sales pitch.

Six boxes, about thirty seconds. You pick when to be called back, and that is when the phone rings.
Or call (559) 340-5097The first legal task after a fatal loss is not a quick answer. It is preserving the facts and separating the claims California recognizes.
Wrongful death and survival actions are separate. The page explains why that matters before anyone treats them as the same case.
For a death at work, the employer report, equipment, schedules, coworker names, and third-party relationships may all matter.
Fresno Superior Court’s Unlimited Civil matters are heard at the B. F. Sisk Courthouse on O Street.
The useful first steps are preserving documents and identifying the right claims, not making a rushed settlement choice.
Nothing is filed and nothing is owed until you decide what to do next.
Gather reports, names, correspondence, photographs, care records, and proof of the family relationship. Keep originals and make copies.
Identify the survivors, any estate representative, and the difference between the family’s wrongful death claim and the decedent’s survival claim.
A case review can identify missing records, likely defendants, the appropriate venue, and requests that should not be answered before the evidence is assessed.

A wrongful death matter changes with the event, the family, the evidence, and the venue. These four questions shape the work.
A crash, jobsite event, delayed diagnosis, unsafe product, or dangerous property each points to different records and possible responsible parties.
California’s wrongful death standing statute and the estate’s role in a survival action are not interchangeable. The family facts need to be right.
Video, damaged vehicles, equipment, worksite conditions, electronic data, and witness memories can all change quickly. Preservation comes before a finished theory of the case.
The location of the death and the parties can determine venue. Fresno’s B. F. Sisk Courthouse handles Unlimited Civil cases, but the facts decide whether that is the proper court.
Fatal crashes, workplace deaths, deaths after care, and uncertainty about the family’s rights each need different records. Start with the situation closest to yours.
A fatal collision file begins with evidence that has a short life. Find out which agency holds the report and its number, photograph the vehicles before anyone tows or rebuilds them, and write down what each witness said while the detail is fresh. Leave insurer paperwork unsigned. The fatal car accident page covers the records, the possible parties, and the California deadlines in full.
When a person dies on a ranch, in a packinghouse, at a yard, or on a road crew, two systems open at once and they answer to different rules. Save the schedule, the task underway, the machine or vehicle involved, and the names of the coworkers who saw it. Ask whether the death was reported to Cal/OSHA within eight hours.
A death that follows treatment leaves a chart rather than an explanation. Request the complete file from every facility involved instead of the discharge summary, and note when each symptom appeared, who was told, and what was ordered. Write down the hour the family learned the condition had changed. Filing dates now control part of what the estate may recover, so the calendar matters as much as the medicine.
Being closest to the person who died does not by itself make someone a claimant here. Code of Civil Procedure section 377.60 sorts eligible people into heirs, dependent relatives, and a qualifying minor of the household. List every relative, every dependency, and any estate paperwork before a filing or a release is discussed. The damages page explains which losses a jury may count.
This page cannot determine responsibility or eligibility for a particular family. It can help you recognize what to save, what to ask for, and why the legal paths should be reviewed separately.

California separates a wrongful death action for eligible survivors under Code of Civil Procedure section 377.60 from a survival action that passes the decedent's own claim to a personal representative or, if none, a successor in interest under section 377.30. Section 377.34 generally excludes the decedent's pain, suffering, and disfigurement from survival damages, subject to statutory exceptions.
Why it matters: The people who lost a family member may have their own wrongful death claim, while a different person may need authority to bring the survival action. Keeping those paths separate changes who is included, what documents are needed, and which losses are being evaluated.

Fresno County Superior Court states that Unlimited Civil cases are heard at the B. F. Sisk Courthouse, 1130 O Street, Fresno, CA 93721.
Why it matters: A wrongful death case can require an Unlimited Civil filing, but venue depends on the case facts. When Fresno Superior Court is the correct venue, the filing goes to the civil division at the B. F. Sisk Courthouse on O Street, and the papers have to match that court's own procedures.

A Fresno County economic study found that agricultural production and processing directly supported 63,103 jobs in 2023.
Why it matters: A local work death may involve a farm, packing operation, processor, labor contractor, transportation provider, equipment maker, or property owner. Preserving the employer, worksite, equipment, and coworker records early helps determine which relationships need to be examined.

The Fresno Irrigation District describes its system as nearly 700 miles of canals and pipeline serving over 200,000 acres of farmland in Fresno County, plus about 980 acres of groundwater recharge facilities.
Why it matters: Open, fast-moving water runs through neighborhoods, farm roads, and worksites across the county. A death in one of those channels raises public property immunity questions with written statutory exceptions that do not arise in an ordinary case.

The Fresno County Sheriff-Coroner reported 9,185 total county deaths in 2024, of which 4,350 were reported to the coroner, 1,138 became case investigations, and 319 received autopsy examinations, with 193 investigations classified as motor vehicle accidents.
Why it matters: A reported death does not automatically produce an autopsy, and the type of examination performed decides what evidence will exist months later. Knowing which file was opened tells a family what to request and when.

California's outdoor heat standard requires potable water of at least one quart per employee per hour, shade when temperatures exceed 80 degrees, cool-down rests of no less than five minutes, and, in agriculture at 95 degrees and above, a minimum ten-minute net cool-down period every two hours.
Why it matters: Fresno's average July high temperature is 97.7 degrees, so the high-heat provisions are routinely in scope. Because the rules are quantified, payroll, break, and temperature records either show compliance or show its absence.

The County of Fresno requires claims for death to be filed with the Clerk of the Board of Supervisors at 2281 Tulare Street, Room 301, and states they are not accepted by email or fax; the City of Fresno requires its Claim for Damages form in duplicate at 2600 Fresno Street, Room 1030.
Why it matters: Where a public agency may be responsible, an administrative claim generally comes before any lawsuit and runs on a six-month period rather than years. Two agencies in the same city use different offices and different filing rules.

California Code of Civil Procedure section 377.60 names the usual starting group: a surviving spouse, registered domestic partner, children, and the issue of deceased children. When there is no surviving issue, people who would inherit under intestate succession can be included. The statute also has rules for certain dependents, including a putative spouse, stepchildren, parents, and some household minors. The facts matter. A relationship that feels obvious in the family may require legal proof, especially with a blended family, a separated spouse, an estate, or a claimed dependency. The safest approach is to list every close relative and the estate status at the outset rather than deciding informally who is “the” claimant.
They are related but distinct. A wrongful death claim seeks the losses eligible survivors suffer because their family member died. A survival action carries forward a claim the person who died could have brought if they had lived; it is pursued by the personal representative or, if there is none, a successor in interest. California’s general rule limits the damages in a survival action differently from the heirs’ losses and excludes the decedent’s pain, suffering, and disfigurement, subject to statutory exceptions that can turn on dates and procedural facts. That is why it is important not to use the two terms interchangeably or let an insurer treat them as the same claim.
The Fresno County Superior Court lists its Unlimited Civil cases at the B. F. Sisk Courthouse, 1130 O Street in Fresno. Whether a particular case belongs in Fresno County, another California county, federal court, or does not need to be filed at all depends on the facts and the parties. Venue is not a choice to make from a map. The location of the event, where defendants live or do business, any contract terms, and the type of claim can all matter. If a claim does belong in Fresno Superior Court, the court’s civil division and filing procedures are concrete local details that should be checked before papers are submitted.
You do not need to turn a family loss into a legal project today. Keep the records, avoid signing away rights before the facts are clear, and get the claim structure reviewed by someone who can identify the correct California path. For a work-related death, ask whether the employer made the required Cal/OSHA report and preserve the worksite information before it changes.
