Medical Negligence Death Claims in California in Fresno, CA Shorter Deadlines and a Statutory Cap

A death that follows treatment runs on its own statutory track in California: a shorter and differently structured deadline, a notice requirement before filing, and a cap on one category of damages. This page describes those rules generally and is not legal advice.

The deadline is not the ordinary one

For an action against a health care provider based on professional negligence, Code of Civil Procedure section 340.5 fixes the outer boundary at three years from the injury date, and a shorter one year measured from when the claimant found out about the injury or, using reasonable diligence, ought to have found out, whichever of the two arrives sooner. The three-year period is tolled only for proof of fraud, intentional concealment, or the presence of a foreign body left in a person with no diagnostic or therapeutic purpose. For a minor the statute provides a period of three years from the date of the wrongful act, and for a child under the age of six a period of three years or until the eighth birthday, whichever provides the longer time. Applying the general two-year death limitation here is a mistake with no remedy.

The notice that must come first

Section 364 prohibits an action for professional negligence against a health care provider unless the defendant has been given at least ninety days' prior notice of the intention to commence the action. The notice does not require the pleading of a specific dollar amount, and where it is served within ninety days of the expiration of the applicable limitation period, the statute extends the time to file by ninety days from the date of service. That interaction between the notice and the deadline is technical, and it is one of the reasons cases in this category are prepared before they are announced.

One category of damages is capped

Civil Code section 3333.2 limits noneconomic damages in these cases. For a wrongful death action against health care providers or health care institutions based on professional negligence, the section sets a separate limit of $500,000 for providers collectively, another $500,000 for institutions collectively, and a further $500,000 for certain unaffiliated providers or institutions whose separate and independent negligence occurred at, or in relation to medical transport to, an unaffiliated institution. The statute took effect for cases filed or arbitrations demanded on or after January 1, 2023, and provides that the wrongful death figures increase by $50,000 each January 1 for ten years up to $1,000,000, with the amount in effect at the time of judgment, arbitration award, or settlement being the one that applies. Beginning January 1, 2034, that ceiling is adjusted annually by 2 percent.

What the cap does not touch

The limit applies to noneconomic losses. Economic losses are a separate calculation, and in a death case they can include the value of financial support the household lost, medical and funeral expenses, and the value of services the person provided. The distinction matters at settlement, because a discussion framed entirely around the capped figure omits the part of the claim that is not capped.

Records are the case

Nothing in a treatment case is visible from outside the chart. Complete records rather than summaries, nursing notes, medication administration records, imaging with the actual image files, laboratory values with times, monitoring data, consult notes, transfer records, and the billing file all carry different information. Requesting them in full and early, with an authorization signed by a person who has authority to make the request, is the entire foundation. Where the estate's representative or successor in interest is the correct requester, that authority question needs to be settled first, which is covered on the survival actions page.

Institutions and public providers

A hospital district, a county facility, or a university medical center may be a public entity, which introduces an administrative claim requirement and a much shorter presentation deadline on top of the professional negligence rules. Clinics, contracted physician groups, staffing agencies, and transport providers may each be separate entities with separate insurers. Establishing exactly which corporate body employed which clinician is ordinary but necessary work, and the answer is usually in the billing records rather than the clinical ones.

Where elder and dependent adult standards overlap

Where the patient was an elder or dependent adult and the conduct alleged is neglect rather than professional negligence, a different statutory scheme can apply, with its own proof standard and its own treatment of damages after death. Care facility deaths therefore get analyzed under both frameworks rather than one, and that analysis is set out on the care facility page.

Fresno's public claim deadlines run on months, not years

The County of Fresno requires claims for death to be filed with the Clerk of the Board of Supervisors at 2281 Tulare Street, Room 301, and states they are not accepted by email or fax; the City of Fresno requires its Claim for Damages form in duplicate at 2600 Fresno Street, Room 1030.

Why it matters: Where a public agency may be responsible, an administrative claim generally comes before any lawsuit and runs on a six-month period rather than years. Two agencies in the same city use different offices and different filing rules.

California uses two different claim paths after a death

California separates a wrongful death action for eligible survivors under Code of Civil Procedure section 377.60 from a survival action that passes the decedent's own claim to a personal representative or, if none, a successor in interest under section 377.30. Section 377.34 generally excludes the decedent's pain, suffering, and disfigurement from survival damages, subject to statutory exceptions.

Why it matters: The people who lost a family member may have their own wrongful death claim, while a different person may need authority to bring the survival action. Keeping those paths separate changes who is included, what documents are needed, and which losses are being evaluated.

Fresno's Unlimited Civil cases have a named filing location

Fresno County Superior Court states that Unlimited Civil cases are heard at the B. F. Sisk Courthouse, 1130 O Street, Fresno, CA 93721.

Why it matters: A wrongful death case can require an Unlimited Civil filing, but venue depends on the case facts. When Fresno Superior Court is the correct venue, the filing goes to the civil division at the B. F. Sisk Courthouse on O Street, and the papers have to match that court's own procedures.
